Scooters Pizza SMS / Terms and conditions:

1. GENERAL
1.1 This competition is conducted in accordance with the provisions of Section 54 of the Lotteries Act, 57 of 1997, as amended and any and all regulations pertaining thereto.
1.2 By participating in the competition, participants/entrants agree to be bound by the rules as set out herein, and which may be amended or varied at any time without notice. It remains the responsibility of the participant/entrant of the competition to acquaint himself or herself with the applicable rules from time to time.
1.3 The promoter of the competition is Scooters Pizza (Pty) Ltd “the Promoter”.
1.4 By entering the competition, via SMS, participants/entrants confirm that they have read and accepted the Terms and Conditions, and amendments thereto, and will be bound thereby.
   
2. RISK
2.1 Due to the nature of the Short Message Service (“SMS”), the “Promoter” cannot be held liable and/or responsible for any risk and/or damage incurred through the use of the SMS services, as well as any risk associated with data security, privacy, availability and reliability of message processing and transmission.
2.2 Participants/entrants enter and take part in the competition entirely at their own risk and the Competition Partners and/or Promoter take no responsibility for any loss, damage or harm suffered, in any manner whatsoever, as a result of such participation and/or in the use of the prize.
   
3. WARRANTIES
3.1 The SMS Competition service is provided “as is” and without any warranties express, tacit or implied by law. Neither the Competition Partners and/or Promoter warrants that access to the SMS competition service will be available, uninterrupted, free from delay or error-free.
   
4. COMPETITION RULES
4.1 The competition shall NOT be open to the following people:
 
4.1.1 Directors, members, partners, agents, employees and/or consultants of Taste Holdings Ltd, Scooters Pizza (Pty) Ltd or any business partner, associate or subsidiary of either of the aforementioned companies, sponsors or any other person connected with the creation or administration of the competition;
4.1.2 The extended families of any of the persons/entities recorded in Clause 4.1.1 above; and
4.1.3 Persons that are not residents of South Africa.
4.2 Participants/entrants of all ages may enter the competition, however, participants/entrants under the age of 18 (eighteen) must obtain permission from their parents/guardians and/or be assisted by their parents/guardians.
4.3 The Promoter may, in its sole discretion, exclude any participant/entrant from participation in the competition, if it believes that the circumstances render the participant unfit to participate.
4.4 The competition will commence on 15 April 2009 and will terminate on 15 October 2009.
4.5 No entries received after the closing date recorded in Clause 4.4 above, will be valid and/or accepted by the Promoter.
4.6 All correct entries received within the prescribed time period will be eligible for the competition and the Promoter shall not be held liable for any incomplete entries or incorrect details.
4.7 There shall be no limit on the number of times a participant/entrant may enter the competition but the Promoter reserves the right to limit the number of entries made by any one individual.
4.8 By entering the competition, the participant/entrant hereby consent to the Promoter entering his/her name into a corporate database that would entitle the Promoter to communicate any future correspondence, in the form of email, newsletters and/or SMS communications and/or loyalty programme registration documentation and/or promotional information, to such participant/entrant. The participant/entrant may unsubscribe from these communications at any time by either contacting the Promoter or following the unsubscribe link applicable.
4.9 By entering the competition the participant/entrant authorises the Competition Partners and/or the Promoter to publish or distribute the participant’s details and/or to take pictures/photographs of the participant/entrant, for which no fee will be payable, and without any liability on the part of the Promoter.
4.10 SMS’s will be charged at R2 per SMS, inclusive of VAT, free minutes or free SMS’s do not apply.
4.11 Proof of a SMS and/or delivery report is not considered 'proof of delivery' and failed requests and/or error messages will be charged.
4.12 The winner of the competition will be chosen by means of an independent random draw. Only the primary account holder of the cellular telephone number drawn from the SMS entries received, will be eligible for the prize.
4.13 The judges' decision will be final and binding, and no correspondence will be entered into.
4.14 Winners will be notified by SMS and/or telephone, as determined in the Promoter’s sole and absolute discretion.
4.15 The winner’s will be awarded “Pizza for a Year”.
4.16 “Pizza for a Year” entitles the winner to any 2 (two) large Scooters pizzas per month, terminating after 1 (one) year from the date upon which the prize is awarded. The total prize equates to 24 (twenty four) large pizzas during the one year period.
4.17 The prize is not transferable and cannot be deferred or exchanged for cash.
4.18 In the event of circumstances beyond its control, the Promoter reserves the right to substitute the prize for one of equal value, calculated in its sole discretion.
4.19 The Promoter will not be held responsible for any delays in the delivery of the prize and in the event that the winner is unable to claim his/her prize, for whatever reason, the Promoter reserves the right to redistribute the prize to another participant.
4.20 The Promoter may disqualify any participant/entrant to the competition who has been announced as a winner should any rule transgressions be discovered at any time after such announcement. The Promoter shall cancel that person’s entitlement to the prize.
4.21 Upon acceptance of the prize, the winning participant/entrant consents to the Competition Partners and/or Promoter publishing his/her name and photograph in any promotional campaign, print and/or public relations material for a period of 18 (eighteen) months from the date of the draw.
4.22 All information relating to this competition and published on any promotional material forms part of the terms and conditions of entry. Should a discrepancy between the competition rules and other promotional material arise, the rules will have preference.
   
5. TERMINATION OF THE COMPETITION
5.1 The Promoter reserves the right to cancel the competition without notice at any time if deemed necessary in it sole and absolute discretion, or in circumstances arising out of its control. In the event of cancellation, all participants/entrants agree to waive any right they may have in terms of the competition and acknowledge that they have no recourse against the Competition Partners, the Promoter, its employees, agents, partners or sponsors.
5.2 If the promoter is required by the Minister of Trade and Industry or the National Lotteries Board to alter any aspect of this competition or to terminate the competition as a result of any changes in legislation, the promoter will have the right to terminate this competition with immediate effect and without notice of such termination. In such event all participants agree to waive any rights they may have in terms of the competition and acknowledge that they shall have no recourse or claim of any nature whatsoever against the promoter, its agents, contractors and/or sponsors.
